The website is provided for our customers to use to find out more about our range of products and services. Products and product information displayed on the website do not represent an offer of sale. To purchase products from us, we invite you submit an order through our online ordering facility.

These terms and conditions apply to online courses and information provided by Growing Kiwi Gardeners

Services

Growing Kiwi Gardeners offers online courses relating to gardening education and related subjects. The course description is intended to indicate only the general nature of the course and does not guarantee content. Growing Kiwi Gardeners reserves the right to amend the course and alter details at its discretion. Courses may be withdrawn at any time.

Payment / Registration

Payment for all courses to be paid in full prior to the course date/course starting.

Courses will be billed in New Zealand Dollars (NZD). Accepted payment methods are Visa, or bank transfer.

You agree to provide accurate and complete registration information. Submission of your registration, alongside payment of the fee constitute your acceptance of these Terms and Conditions.

Cancellations and Refunds

You may cancel your registration up to the day before the course starts. Following the start of the course, a refund cannot be offered.

Growing Kiwi Gardeners reserves the right to cancel a course by giving you notice in writing (including by email) at any time before the course start date. Growing Kiwi Gardeners will refund all fees paid by you for the cancelled course. Growing Kiwi Gardeners’ liability when it cancels an Online Course will be limited to a refund of the Fee or any other charges paid for the cancelled Online Course.

Copyright

All materials – including but not limited to text, photographs, video, audio, images and any other content – appearing via the Online Course and/or on the Website are protected by copyrights and/or other proprietary rights belonging to Growing Kiwi Gardeners and/or other third parties. You agree to abide by all applicable laws regarding copyrights, trademarks, publicity rights and privacy rights in NZ, the US, UK and any other jurisdiction from which you are accessing the Website.

You may not copy, reproduce, duplicate, distribute, disseminate, publish, post, display, perform, modify, create derivative works from, upload to, transmit, or in any way exploit any content from the Online Course and/or on the Website. You may not sell or offer for sale any of the content, or allow third parties to access it, or use such content to construct any kind of database. You may use the content from the Online Course and/or on the Website only for personal, non-commercial use.

You agree to maintain the security of any user name and password required for accessing the Online Course. You will notify us promptly if you become aware of any unauthorised use of your username and/or password. Only you may access the course using your login details.

Data Protection

By registering with Growing Kiwi Gardeners and by paying the fees, you agree to Growing Kiwi Gardeners collecting and using your personal data. This will be done in accordance with Growing Kiwi Gardeners privacy policy.

Limitation of Liability

Except in case of intentional misconduct or gross negligence, Growing Kiwi Gardeners accepts no liability for any damages caused in connection with the services under this agreement. This includes but is not limited to damages in the form of data loss, failure to operate, lost revenue or missed profits.

Law and Venue

Any disputes in connection with this agreement are governed by New Zealand law and must be brought before the courts of New Zealand.
